1. Who we are
Santa Fe Performing Arts Collaboration, doing business as Santa Fe Improv, is a 501(c)(3) nonprofit organization in Santa Fe, New Mexico. FEIN 83-3988484. In these Terms, “SFI,” “we,” “us,” and “our” mean Santa Fe Improv, and “you” means the person using our website or buying from us.
2. Agreeing to these Terms
By using santafeimprov.org, enrolling in a class, buying a ticket, or hiring us for a workshop, you agree to these Terms.
You may also sign separate agreements with us, including a waiver and release of liability, a consent to filming and photography, or a workshop contract. Where one of those conflicts with these Terms, the signed agreement governs.
3. What we sell
We sell improv and writing classes, tickets to performances, workshops for businesses and organizations, programs for schools, and access to recorded courses.
Class descriptions, schedules, prices, and instructor assignments are accurate when published and can change. Where a change materially affects a class you have already paid for, we will tell you and section 6 applies.
4. Enrollment and registration
Enrollment is confirmed when payment is received and we send confirmation. Some classes have prerequisites, a minimum age, or a minimum enrollment, and these are stated on the class page.
You are responsible for giving us accurate contact information and for keeping it current.
When classes have limited seats, we fill them in order of paid enrollment, with exception for students directly enrolled by permission of the instructor or Artistic Director.
5. Prices and payment
Prices are in US dollars and are shown on the page for each class, performance, or course.
Ticketing and registration are handled by Ticket Tailor and payments are processed by Stripe. Your card details go to Stripe and are not received or stored by us. Using those services means accepting their terms as well as ours.
Payment is due at the time of enrollment or purchase unless we have agreed otherwise in writing.
6. Refunds and cancellations
Classes. If you withdraw 48 hours or more before the first session, you receive a full refund. If you withdraw after that but before the second session, you receive a credit for half the amount paid, good toward a future class. After the second session there is no refund or credit. At any point before the second session you may transfer once to a future class at no charge.
If we cancel a class. If we cancel a class before it begins, whether for low enrollment or any other reason, you receive a full refund.
If a session cannot be held. If a session cannot be delivered and cannot be rescheduled, you receive a refund for that session. If a class ends before all sessions are delivered, you receive a refund for the sessions not delivered, unless the class ended because of your own conduct.
Tickets. Tickets to performances are non-refundable. If you ask at least 24 hours before the performance we will exchange your ticket for another performance where seats are available. If we cancel a performance, you receive a full refund or an exchange, whichever you prefer.
Recorded courses. Access to a recorded course is sold for a defined period. You may request a refund within seven days of purchase if you have not worked through a substantial part of the course.
Workshops and school programs. These are governed by the contract signed for that engagement, not by this section.
Removal for cause. A participant removed from a class for the reasons in section 7 is not entitled to a refund.
Processing fees. Payment processing fees charged on a transaction may not be refundable.

7. Conduct and removal
Improv depends on people feeling safe enough to take risks in front of each other. We expect every participant and audience member to treat others with respect. That includes acknowledging that, because of the immediate and unfiltered nature of the work, while we seek to entertain and provide positive experiences, mistakes may be made, some jokes may be considered offensive or in poor taste, and that words are not violence.
That said, we may decline to enroll someone, or remove someone from a class, performance, or venue, for any legitimate reason, including prior, current, or threatened disruptive behavior, harassment, or violation of the Code of Conduct. Where circumstances allow, we give a warning first. Serious conduct does not require a warning.
An instructor may remove a participant from a session immediately if there is a safety concern. Every other removal decision is ours.
We do not decline or remove anyone on the basis of race, color, religion, gender, gender expression, age, national origin, disability, marital status, veteran status, or sexual orientation, and we do not remove anyone for having raised a complaint unless that complaint or pattern of complaint rises to the level of disruptive behavior.
8. Waiver and release
Improv classes and performances involve physical movement and carry a risk of injury. Every participant is asked to sign a waiver and release of liability before taking part. Participation is not permitted without a signed waiver. If a participant does not sign the waiver (e.g. they pretended to) and chooses to participate in class, that participation counts as accepting the terms of the waiver. Where the participant is under 18, a parent or guardian signs.
9. Photography and recording
We photograph and record classes, workshops, and performances, and use that material to promote our programs.
Adult participants sign a consent to filming and photography. Audience members are notified that recording may take place, and attending a performance means agreeing to appear in it.
For participants under 18, we obtain written permission from a parent or guardian before using their image, and we honor a decision to opt out.
To ask that an image be taken down, write to admin@santafeimprov.org. We will remove it from the properties we control. We cannot recall material already printed or shared by others.
10. Participants under 18
Registration for a participant under 18 must be completed by a parent or guardian, who signs the waiver and the photography consent on the participant’s behalf and provides emergency contact information.
Where we work inside a school, the school’s own permissions and policies govern participation.
11. Our intellectual property
The website, its text, images, video, design, and the SFI name and logo belong to us or to the people who licensed them to us. You may not copy, republish, sell, or make derivative works from them without our written permission.
You are welcome to link to our pages and to share our posts and newsletter.
12. Course materials and instructor content
Class handouts, exercises, slides, and recordings are provided for your own use as a participant. You may not record a class, copy the materials for distribution, or teach from them without written permission.
Some of what is taught belongs to the instructor rather than to SFI. Nothing you receive as a participant transfers any rights in it to you.
13. Testimonials and feedback
If you give us a testimonial, you are giving us permission to publish it, along with your name and photograph if you have provided them. Write to us at any time to have it removed.
Ideas and suggestions you send us unprompted are not confidential, and we may use them without owing you anything for them.
14. Other companies’ services
Our website relies on services run by other companies, including Ticket Tailor for ticketing, Stripe for payments, Klaviyo for email and text messages, and Google for maps and analytics. Those services have their own terms and privacy policies, and we are not responsible for how they operate.
Our website links to other websites. We do not control them and are not responsible for their content.
15. Using the website
Use the website for what it is for. Do not attempt to break, overload, or gain unauthorized access to it, do not upload anything malicious, do not scrape it for marketing lists, and do not use automated tools to collect information from it.
16. Email from us
Joining our email list means agreeing to receive messages about our classes, shows, and programs. Every message includes an unsubscribe link. Our Privacy Policy explains what we collect and how we use it. Text messaging is governed by the Mobile message service section below.
17. Mobile message service

The Santa Fe Improv mobile message service (the “Service”) is operated by Santa Fe Improv (“Santa Fe Improv”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Santa Fe Improv’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Santa Fe Improv through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., class reminders, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., show announcements).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Santa Fe Improv. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18448203742 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Santa Fe Improv mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

18. No warranty
The website and its content are provided as they are. We work to keep them accurate and available, and we do not promise that they will be error-free or uninterrupted.
Nothing on our website is legal, financial, medical, or psychological advice. Improv is a performing art and an educational program. It is not therapy and is not a substitute for professional care.
19. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential damages arising from your use of the website or participation in our programs.
Where liability cannot be excluded, our total liability to you is limited to the amount you paid us for the class, ticket, or course the claim relates to.
Nothing here limits liability that cannot lawfully be limited, and nothing here replaces the separate waiver and release you sign as a participant.
20. Indemnification
You agree to cover our costs, including reasonable attorney’s fees, arising from your breach of these Terms or your violation of the law or of anyone else’s rights.
21. Privacy
Our Privacy Policy explains what personal information we collect and what we do with it. Our Opt-out Preferences page covers cookies and lets you change your choices.
22. Changes to these Terms
We may update these Terms. The effective date at the top shows the most recent revision. Continuing to use the website or our programs after a change means accepting the updated Terms.
23. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of laws principles. Any dispute arising from them will be brought in the state or federal courts located in Santa Fe County, New Mexico.
If any part of these Terms is found unenforceable, the rest stays in effect.
